The circumstances of this case support equitable tolling of the statute of limitations. Prior to September of 2004, science had made no causal connection between the hep B vaccine and MS. Once Dr. Cloer was made aware of a potential link, she exercised due diligence in investigating, researching, and filing a claim in the Vaccine Program.
