“Independent living” does not mean that people with disabilities must lead fully independent and self-sufficient lives away from other people. On the contrary, it is rather the social model of disability, according to which people face the problem of limited choices not because of any of their own congenital characteristics or diseases, but because of the limitations imposed on them by society and the physical environment in which they live. In a socially-oriented society, a person with a disability is provided not so much with physical assistance, but with support in making independent and autonomous decisions (and in some cases assistance in making such decisions), on an equal footing with the rest of society. According to one scholar who studies the problem of disability, “In reality, in the conditions of modern industrial society, no person is completely independent: we are all dependent on one another in one way or another. Consequently, the dependence experienced by people with disabilities is not their distinctive feature and does not set them against other members of society. 8 The only problem is that the aids that some people with disabilities have to use (for example, adapted means of transportation) are more visible than the services and infrastructure that are available to all other people who lead an “independent” life in society.

The notion of independence plays an important role in ensuring equality for people with disabilities. The “independent living” movement advocates respecting the right of people with disabilities to personal autonomy and control over their own lives, as well as demanding that people be provided with public services that enable them to live independently in society.9 Independent living means that a person chooses the life that suits him or her – in the family, separately from it or in any other conditions he or she wishes. Restricting people’s general freedom of choice and their right to respect for that choice inevitably jeopardizes their ability to make more specific choices, such as their choice of where to live and how to live in society. At the same time, social isolation increases the risk that people with disabilities will be recognized as disabled. The lack of choice and rigid external control that are the hallmarks of life in institutions mean that a person with a disability has virtually no say in their own destiny.

Recent high-profile cases in the European Court of Human Rights have highlighted human rights violations resulting from the incapacitation and institutionalization of people with disabilities.12 Given the fact that many jurisdictions generally grant guardians the right to place persons with disabilities in such institutions, recent rulings imply that these states will have to reconsider those provisions of their legislation that equate guardian consent with the consent of the incapacitated person himself. The problem of the isolation and confinement of people with disabilities in specialized institutions has existed for many years and is very painful. Nevertheless, recently the idea that disabled people can and should remain independent and participate in society has become increasingly popular. Despite the fact that Article 19 of the UN Convention on the Rights of Persons with Disabilities largely influences the deinstitutionalization of specialized institutions and the formation of services for people with disabilities, genuine compliance with the provisions of the Convention requires radical changes in society, a rejection of patronizing and aloof attitudes toward the needs and requirements of people with disabilities, and the adoption of measures to ensure that people with disabilities can live the lives that are optimal for them.

Existing international law already provides all the foundations for the effective realization of the right of persons with disabilities to live a full life in society. Today there are a number of achievements in this sphere that go beyond the scope of this study.

Some states have already come close to achieving this goal, abandoning specialized institutions in favor of in-home services for people with disabilities or creating entirely new services and support systems where they did not previously exist. Such successes should be applauded, built upon, systematized, legislated and aligned with human rights standards.
